MHA adopted 72% of 111 suggestions on criminal laws by House panel: Officials
criminal laws, Home ministry officials said that MHA has incorporated 72% of 111 suggestions made by the Department Related Parliamentary Standing Committee (PSC) which examined the draft laws in August 2023. «The PSC forwarded its recommendations to the MHA on November 10, 2023. MHA has incorporated most of the suggestions given by PSC and out of 111 observations, MHA has incorporated around 72% of them,» the officials said. The remaining suggestions were either in terms of observations of the Committee or the existing provisions in the Bills were already meeting the suggestions of PSC. The old set of Bills were subsequently recalled and, after incorporating suggestions and feedback, the current three Bills were tabled, they added. MHA has initiated steps towards preparing the existing organs of the Criminal Justice System to successfully adapt themselves to these new laws. As per officials, «these measures would require training at all levels in the police, vast improvement of forensic capabilities at all levels, evolving best practices for adopting technological solutions at police station and court levels, preparing various guidelines on initiatives like Witness Protection Scheme, etc. Further, commensurate capacity building steps have to be undertaken by all states and UTs».

India must reflect & implement essential reforms to strengthen the arbitration process
Arbitration has been struggling to take off in India since the first Arbitration and Conciliation Act, 1996. This is worrisome. From PM to vice-president, many have argued for a sound institutional arbitration process. Law minister Arjun Ram Meghwal recently even wondered why India can't become the hub for arbitration in the Asia-Pacific region. As efforts are made to ensure its take- off, a recent finance ministry notification has the potential to nix the Act. It prohibits automatic arbitration clauses in any procurement and requires that even if one is incorporated, it be for less than ₹10 cr. The primary reason behind this is GoI's unsatisfactory experience in arbitration. The alternative prescribed is mediation or the courts, whose track record in timely disposal is poor. Most contracts come with an arbitration clause because it is quick, and the awards are final. It is the choice for businesses not only in India but all over the world.

India's lawyers, activists protest against new criminal laws
Indian lawyers and activists are urging Prime Minister Narendra Modi's government to put on hold three sets of new criminal laws, arguing they will increase litigation in an already overburdened justice system and give excessive powers to police. India this month replaced its criminal justice system — the Indian Penal Code of 1860, the 1973 Code of Criminal Procedure and the Indian Evidence Act of 1872 — with new laws. The new laws, in force since July 1, expand police powers on pre-trial detention of an accused and introduce the death penalty for gang-rape of women aged under 18, among other provisions. They also mandate judges to issue written rulings within 45 days after a trial ends and for charges to be framed within 60 days of the first court hearing in a case.

Money laundering case: HC extends Jet Airways founder Naresh Goyal's interim bail by 4 weeks
Bombay High Court on Friday extended by four weeks the interim bail on medical grounds granted to Jet Airways founder Naresh Goyal, accused in a money laundering case. On May 6, the high court had granted interim bail for two months on medical grounds to Goyal, arrested in a money laundering case by the Enforcement Directorate (ED). 75-year-old Goyal has now filed an application seeking extension of the same. Goyal, who is suffering from cancer, had submitted to the high court that he has to undergo a preliminary laparoscopic surgery. His counsel Aabad Ponda told a single bench of Justice N J Jamadar that the surgery is scheduled on July 23. The bench took note of this and extended the interim bail for four weeks. «Having perused the medical reports and the situation in which the applicant finds himself, in the backdrop of the physical and psychological ailments, aggravated on account of the demise of his wife, I deem it appropriate to extend the interim bail on medical ground by a period of four weeks,» the HC said. It would hear Goyal's plea for bail both on merits and medical grounds on August 2.
