Jio submits another legal opinion on satellite spectrum backing auction
auction satellite spectrum, Reliance Jio has submitted to authorities, including regulator Trai, another legal opinion from a former Supreme Court judge who has opined that while there is no mandate, constitutional or otherwise, that natural resource allocation must be only by auction, it is certainly “a more preferable method”. As per Justice L Nageswara Rao, former judge of Supreme Court, in light of commercial considerations underpinning the allocation of satellite spectrum and sans any social or welfare objectives, any law or rules providing for a method other than auction, raising concerns on its legality, could be found “constitutionally unsound under Article 14 of the Constitution of India.” The judge has given his opinion of a query from Jio seeking to know whether under the constitutional and legal regime in India, auction is the only permissible mode of assignment of spectrum for commercial space-based communication services. Earlier, Jio had shared the opinion of former Supreme Court judge KSP Radhakrishnan to Telecom Regulatory Authority of India (Trai) to back its view that auction should be the mode of spectrum allocation for satellite communication services. This comes on the heels of satcom companies sharing the view of former attorney general Mukul Rohatgi, who said auction isn’t the most appropriate and efficient method of resource allocation. As per Justice (retired) Radhakrishnan, when natural resources are made available to private parties for their own gain, the state must endeavour to maximise its own revenue by adopting competitive means of disposal.

Telcos to spend less on 5G spectrum in next auction : Crisil
telcos are likely to spend less on 5G airwaves in the next auction compared to the last one in July 2022 as they have adequate spectrum holdings, ratings agency Crisil said. “All private telcos are believed to be adequately placed, having purchased spectrum worth Rs 1.5 lakh-crore in the previous auction…hence, the outgo for spectrum purchase at the next auction is expected to be lower than the previous one,” Crisil said in an official statement Monday. The government had mopped up over Rs 1.5 lakh-crore from India’s first auction of 5G spectrum last year, selling around 71% of the over 72 GHz of airwaves it put on the table.

Vodafone Idea (Vi) has extended the redemption period of 8,000 optionally convertible debentures (OCDs) – out of the Rs 16,000 OCDs issued to American Tower Corp’s India unit (ATC Telecom Infrastructure Pvt Ltd) – to 18 months from the allotment date, instead of the earlier six-month deadline. “The company and ATC have agreed to extend the period of redemption of 8,000 OCDs from 6 months, from the date of allotment of first tranche of OCDs (which was falling due on 28th August, 2023), to 18 months from the date of allotment, subject to certain conditions as mutually agreed,” Vi said in an exchange filing Monday morning. Last month, Boston-based ATC had informed the US Securities and Exchange Commission (SEC) that Vi’s OCDs would mature in two tranches of Rs 800 crore each on August 27, 2023 and August 27, 2024. That has now changed. Earlier in Febuary 2023, Vi had allotted OCDs worth Rs 1,600 crore to ATC TIPL against its dues.
