Birthright citizenship is one of the three Reconstruction Amendments adopted after the Civil War, aimed at addressing issues related to former slaves and establishing broader protections for civil rights.
Starting from February 19, 2025 (i.e. after the 30 days mentioned above), the following group of children born in the US would not be citizens of the US:
- A child born to a mother who is in the US illegally and a father who is neither a US citizen nor a Green Card holder at the time of birth.
- A child born to a mother who is lawful in the US but in a temporary status, and the father is not a US citizen or US lawful permanent resident (Green Card holder) at the time of the child’s birth. This will include children born to individuals who are in the US on non-immigrant visas or other temporary status, including but not limited to those on B-1/B-2 visas, F-1/F-2 visas (or another student status), H-1B, H-4, L-1, L-2 TN, O-1, P-1, etc.
