Raghav Chadha Bungalow Row: Delhi HC sets aside Patiala House court order to evict AAP MP
Raghav Chadha from his official residence in the national capital Delhi. The Aam Aadmi Party (AAP) leader and Rajya Sabha MP had moved the Delhi High Court against Patiala House Court's recent order which has enabled Rajya Sabha Secretariat to evict Raghav Chadha from his current accommodation. The Court revived it’s 18 October order of granting the MP an interim stay from arrest till the city court decides MPs application seeking injunction from eviction.

Dial T for telco tax: Supreme Court rings in tweaks
additional tax liabilities of about $1 billion on the telecom sector this fiscal year alone, impacting operator cash flows, the Supreme Court on Monday held that licence fees payable by the telcos will be treated as entirely «capital in nature». It set aside a Delhi HC order that categorised licence fees before and after July 31, 1999, differently, as capital expense and revenue expense, respectively. Rejecting this recharacterisation, a top court bench comprising Justices B V Nagarathna and Ujjal Bhuyan said the licence fees remain capital regardless of instalment payments after the New Telecom Policy 1999 came into effect. Big setback for older telcos The order is a setback for older telecom companies Bharti Airtel and Vodafone Idea, and, to a lesser extent, even for Reliance Jio, as they will need to reassess their financial structures and potentially face increased tax liabilities. «Variable licence fees will be treated as a capital expenditure and, as a corollary, the deduction will not be allowed in the year of the expenditure now,» said taxation lawyer Abhishek A Rastogi, founder of Rastogi Chambers.

Supreme Court on Monday agreed to hear a plea by Congress leader Pawan Khera challenging the Allahabad High Court's refusal to quash criminal proceedings against him for allegedly making objectionable remarks against Prime Minister Narendra Modi. A bench of Justices B R Gavai and Prashant Kumar Mishra sought responses, including from the state of Uttar Pradesh, on Khera's plea challenging the August 17 order of the high court. «Issue notice,» the bench said.

Movin commences EV operations in Bengaluru
Movin, a joint venture between UPS and InterGlobe Enterprises, on Monday, started operations by introducing the second fleet of Electric Vehicles (EV) for its first and last-mile deliveries in Bengaluru, said the brand through its press release. The first fleet was rolled out in Delhi NCR earlier this year. EVs will soon be deployed in Mumbai, Chennai, Hyderabad, Kolkata, and Pune by the end of 2023 as part of its plan to reduce carbon emissions and to align with its long-term sustainability goals, said the company in its statement.

HC seeks ED stand on Arun Ramchandran Pillai's bail plea
Pillai, the alleged frontman of Bharat Rashtra Samithi leader Kavitha Kalvakuntla, has submitted that he is neither the frontman nor the representative of Kavitha of any liquor cartel allegedly involved in the Delhi liquor excise scandal. According to the Enforcement Directorate (ED), Pillai, a Hyderabad-based businessman and co-accused in the Delhi government's now scrapped excise policy case is Kalvakuntla's «benami» or frontman. In his bail plea filed earlier this month before the Delhi High Court, Pillai has submitted that the entire case made out against him by the ED is solely based on statements of witnesses and co-accused recorded under Section 50 of the Prevention of Money Laundering Act (PMLA). Statements recorded under the said section are admissible in a court of law. Advocate Nitesh Rana, appearing on behalf of Pillai, argued before the high court that the admissibility of such statements is to be examined at the stage of trial.
