AAP to observe 'samhuik upwas' to protest Arvind Kejriwal's arrest
Aam Aadmi Party (AAP) is gearing up for 'Samuhik Upwas' or mass fasting on Sunday to register its protest against the arrest of party chief and Delhi chief minister Arvind Kejriwal in the excise policy scam. Earlier, AAP leader Gopal Rai gave details of the event which, he said, is aimed at showing solidarity for the party chief. The day's itinerary would include a congregation of supporters at Delhi’s Jantar Mantar and Khatkar Kalan in Punjab, the ancestral village of Shaheed Bhagat Singh, where AAP leaders and party workers would observe mass fast.

Keep taxpayers in the loop before you act: Court to Income Tax dept
Income Tax department is coming after them without informing them by an email or letter. They are clueless that the tax office has initiated action by simply posting the show-cause notice or summon on the department's e-portal. Such assesses who don't check the tax portal regularly — in fact, few do — may be in for shock and penalty. But how fair is this? According to a recent High Court ruling, this is no way for tax authorities to deal with either individuals or corporations who are not expected to keep the e-portal open all the time to figure out what the taxman is up to. Quashing a November 2022 show-cause notice against Munjal BCU Centre of Innovation and Entrepreneurship, The Punjab and Haryana High Court said «it is essential that before any action is taken, a communication of the notice must be in terms of the provisions» of the law that provides for a method and manner of service of notice and orders. «The provisions do not mention communication to be „presumed“ by placing notice on the e-portal,» said the order given a month ago.

Manish Sisodia, in the Delhi excise policy case are making a conscious attempt to delay the trial. Opposing the bail plea of Sisodia, the counsel for ED contended that there has been no delay from the side of the prosecution. Rather, the accused have made deliberate and concerted attempts to delay the trial, the ED alleged. The agency further averred that 95 applications have been moved by 31 accused (before the court) in the case, including six applications by Sisodia. The ED's counsel alleged that majority of the applications moved by the accused are frivolous.

Legislative amendments needed to expand jurisdiction of family courts: Justice Hima Kohli
Hima Kohli, who heads the Supreme Court's committee for family court matters, on Saturday suggested legislative amendments to expand the jurisdiction of family courts and enhance their efficacy for smooth and effective disposal of cases. In her keynote address at a two-day regional conference for northern zone on family court matters, Justice Kohli said the Family Courts Act which came into being in 1984 is comprehensive but it has its limitations which contribute to the inefficacy of family courts. A significant limitation of the Act is its silence on granting injunctions against domestic violence, she said. «The gap was partially addressed by the Protection of Women From Domestic Violence Act, 2005 but jurisdictional challenges persist,» Justice Kohli said.

K Kavitha, arrested in the Delhi excise policy-linked money laundering case, moved a court here on Saturday opposing a CBI plea that sought her interrogation in Tihar jail in a corruption case related to the alleged scam. The court on Friday allowed the Central Bureau of Investigation (CBI) to quiz Kavitha in Tihar. The order was passed on the plea filed by the CBI seeking the court's permission to interrogate Kavitha in judicial custody. Advocate Nitesh Rana, appearing for Kavitha, told the court that CBI thwarted the due process of law by filing the plea «behind her back». «I have grave apprehension that CBI may not have divulged true facts in order to obtain a favourable order from the court,» he told the court and urged it to keep the order in abeyance until Kavitha's side is heard.
