SC expresses concern over an accused in prison without trial
Supreme Court on Wednesday expressed its deep concern on keeping an accused in custody without trial on the pretext of filing successive charge sheets by probe agencies. A division bench headed by Justice Sanjiv Khanna made these remarks, lamenting the Enforcement Directorate's practice of filing supplementary charge sheets in money laundering cases to defeat the accused's right of getting default bail. Justice Khanna verbally remarked that «this is just not done». The bench added that the probe agency ought to ensure commencement of the trial once it files a charge sheet. «How you conduct an investigation is your prerogative. But you cannot say that you will keep filing successive charge sheets and keep the accused in jail without trial,» justice Khanna verbally remarked on the plea of an accused booked by ED in a case of illicit mining. The bench noted that Prem Prakash, the accused, has been behind bars for the past 18 months.

CCI ordered an investigation into Google's Play Store billing policies, saying that the tech giant has prima facie violated the Competition Act. It asked the director general to probe the issue and submit a report in 60 days. Google earlier offered the Play Billing System (GPBS), under which app developers could only offer the tech giant's own payment method for in-app purchases and were levied a commission of 15-30%. This was held uncompetitive by CCI in 2022. Following this, Google introduced user-choice billing system (UCBS). Under UCBS, apps could offer other payment methods, such as UPI, credit cards and net banking, but it would also attract a commission rate of 11-26%. Internet apps approached CCI, alleging that UCBS was GPBS in a newer avatar and violated CCI's earlier order. In its 21-page March order, CCI said that imposition by Google resulted in app developers having fewer resources to enhance or develop their app offerings, thereby constraining the growth of the app market.

India’s probe finds rogue officials involved in Pannun murder plot
investigation into US claims of an attempted murder of a Sikh leader in New York found that rogue operatives not authorized by the government had been involved in the plot, according to senior officials familiar with the matter. I-T dept expands scope for filing appeals by tax officers, includes TDS disputes
CBDT has permitted income tax authorities to file appeals irrespective of monetary threshold in cases relating to TDS/TCS, undisclosed foreign income, or information received from investigating agencies like ED and GST Intelligence. Currently, tax authorities can file appeals before the ITAT, High Court and Supreme Court, if the disputed tax demand exceeds Rs 50 lakh, Rs 1 crore and Rs 2 crore respectively — a threshold fixed in 2019. The Central Board of Direct Taxes (CBDT) in a circular dated March 15 said that the said monetary limits will not be applicable for filing appeals in cases where prosecution has been filed by the department in the relevant case, and trial is pending and conviction order has been passed and the same has not been compounded. Cases where the assessment is based on information with regard to an offence alleged to have been committed under any other law and information received from law enforcement or intelligence agencies like CBI, ED, DRI, SFIO, NIA, NCB, Directorate General of GST Intelligence (DGGI), and state law enforcement agencies, in such cases the appeals would be filed irrespective of the tax demand on the assessee.
