The Constitutional Basis for Disqualification
No one who has previously taken an oath to support the Constitution of the United States shall hold any office, civil or military, under the United States or any state, and shall have given aid or comfort to the enemies thereof or engaged in insurrection or rebellion against the Constitution.
In each House, a two-thirds majority vote is required to remove this disability, as quoted in a report by The Hill.
The basis for disqualification is rebellion against the Constitution, not the state. The proof that Donald Trump participated in such an uprising is overwhelming.
