RBI tells banks to take legal recourse in standoff with CBI
Reserve Bank of India (RBI) has advised banks to seek legal remedy in case of a stand-off with the Central Bureau of Investigation (CBI) over matters classified as fraud. The RBI's advice was in response to the CBI returning complaints filed by some banks to probe accounts tagged as fraud and where they have already filed an FIR (first information report). In several cases, the investigative agency has informed the lender that its complaint has been returned because the borrower concerned has not been given an in-person hearing before the account was classified as fraud.

Loss-making MNCs liable to pay tax on India setup
India or engaging people to promote, operate and grow their businesses from the Indian market will have to pay tax attributable to such setups even if these MNCs report losses in their global balance-sheets. This was laid down by a three-judge bench of the Delhi High Court in a ruling which would impact several MNCs using liaison office, subsidiary, or a fixed place like a hotel room — arrangements which are considered as 'permanent establishment' or PEs in tax parlance — to meet customers, negotiate prices, and market products and services. The ruling, pronounced on September 19, was in response to a petition by the UAE-based Hyatt International Southwest Asia which had a fixed place or PE in India at the premises of Hyatt Regency hotel in Delhi.

DND flyover operator Noida Toll Bridge Company gets massive ₹21,000 crore tax relief
Noida Toll Bridge Company Limited (NTBCL), the Income Tax Appellate Tribunal (ITAT) has quashed a massive tax demand of approximately ₹21,000 crore. The listed entity, part of the IL&FS Group, operates the Delhi-Noida-Delhi (DND) flyover, a critical infrastructure link between the two cities. The tax demand, spanning nine financial years from 2006 to 2015, included ₹10,893 crore in alleged unpaid taxes and the same amount in penalties. The Income Tax department had accused NTBCL of concealing income and failure to submit accurate income details. The Income Tax department issued an assessment order on December 31, 2008, followed by reassessment proceedings. These proceedings sought to disallow amortization of interest on zero-coupon bonds issued by NTBCL and taxed designated returns as income. Additionally, the department classified land provided by NOIDA/DDA on lease as a subsidy and disallowed depreciation on the DND Toll Bridge.
