While the supporters of the new Louisiana law argue that it will deter people from committing sex crimes against children, its opponent counters it by calling it “cruel and unusual" punishment in violation of the U.S. Constitution.
However, it will depend on the discretion of the judge as now he will have the option to sentence someone to surgical castration. The new law will apply to certain aggravated sex crimes, including rape, incest and molestation against a child under the age of 13. The sentence is not automatic, it would vary from case to case.
